Hong Kong Tycoon Jimmy Lai Wins Appeal Against 2022 Fraud Conviction Amid National Security Sentencing
Hong Kong pro-democracy media tycoon Jimmy Lai has won an appeal against his 2022 fraud conviction, which had previously sentenced him to nearly six years in jail.
The Court of Appeal in Hong Kong on Thursday quashed the convictions of Lai and another defendant accused of illegally subletting office space. Despite the ruling, the 78-year-old businessman remains in prison after being sentenced earlier this month to 20 years under the city’s national security law for collusion with foreign forces.
Lai, a British citizen and outspoken critic of Beijing, has been detained since 2020 and is one of the most prominent figures in Hong Kong’s pro-democracy movement. His daughter, Claire Lai, described Thursday’s ruling as “nothing more than a PR move by the Hong Kong authorities,” adding that her father remains unjustly imprisoned.
Caoilfhionn Gallagher KC, head of Lai’s international legal team, echoed these concerns, stating that the overturning of the fraud conviction “changes nothing” and highlighted the risk to Lai’s health in detention.
In 1995, Lai founded Apple Daily, a pro-democracy tabloid critical of Beijing that became Hong Kong’s largest pro-democracy newspaper before it was shuttered in 2021 amid arrests of key staff, including Lai. The fraud trial stemmed from allegations that Lai breached lease agreements by subletting office space to his private consultancy while Apple Daily occupied the premises.
Wong Wai-keung, a former executive at Lai’s media company, was also jailed for 21 months in the same case. Critics say Lai’s trials reflect a broader erosion of civil liberties in Hong Kong following the implementation of Beijing-imposed national security laws.
International observers, including the governments of the UK and the US, have voiced concerns that the law has been used to suppress pro-democracy activists like Lai. Chinese and Hong Kong authorities, however, maintain that the law is necessary for stability and does not undermine Hong Kong’s autonomy.
Human rights groups and Lai’s family have expressed deep concern over his deteriorating health in prison. Last year, his daughter reported serious medical issues, including dental decay and fingernail problems, although authorities assert that he is receiving adequate care.
Supporters of Jimmy Lai continue to view his detention as politically motivated. The overturning of the 2022 fraud conviction has been met with skepticism, as Lai remains incarcerated under the long national security sentence.
